This is the situation currently unfolding at the Food and Drug Administration (FDA), where regulators have until March 31 to comply with a consentjudgmentby responding to a petition by the Natural Resources Defense Council (NRDC) to ban the use of the chemical bisphenol A (BPA) in food packaging, food containers and other materials likely to be ingested or to come into contact with food.
The consentjudgment issued by a U.S. District Court in New York is the result of a lawsuit filed by the NRDC in 2010 in an attempt to achieve through litigation what it could not achieve through science-based evidence.
