R. 3149, was introduced this summer to amend the FairCreditReportingAct to prohibit the use of consumer credit checks against prospective and current employees for the purposes of making adverse employment decisions.
But using it in the life-insurance application process would "raise questions" about whether the data would be subject to the federal FairCreditReportingAct, says Rebecca Kuehn of the Federal Trade Commission's division of privacy and identity protection.
Last week, the agency sent letters warning three marketers of mobile apps that provide background checks that they might be violating the FairCreditReportingAct.
