财政法是调整国家财政收支关系的法律规范的总称。它是规范市场经济主体、维护市场经济秩序的重要工具。由于财政作为国家参与国民收入分配和再分配的重要工具和国家宏观调控的重要手段，处于各种利益分配的焦点上，涉及面广，政策性强，没有强有力的财政法作保障，财政的宏观调控作用就得不到充分发挥，因而财政法在振兴国家财政中的重要作用。
在1959年《财政法》（the Finance Act）颁布以前，法院一直认定，承保条仅具有道义上的约束力，因此，并非一份有效的海上保险合同。
