租赁保证金是为保证租赁合同的履行，承租人在合同订立时按应付租赁标的价款(或租金) 的一定比例，付给出租人的担保金。保证金交付后： ①如果承租人不履行租赁合同的有关规定，就无权要求返回保证金。②如果出租人接受保证金后不履行租赁合同，根据惯例应加倍向承租人返还保证金。③如果承租人按规定正常履行合同，保证金可以抵消部分租赁物的价款或租金。承租人交纳保证金多少，依双方签订合同时根据标的物、承租方等情况商谈一个适当比例而定，一般为租赁物价款的5%～15%。
