不纯正不作为犯罪，是指行为人负有实施某种积极行为的特定法律义务，并且能够实行而不实行的犯罪形式。不作为，即消极的行为，是指行为人不履行特定的应尽义务的行为。有的犯罪只能由不作为构成，如遗弃罪、偷税罪，这种犯罪称为纯正不作为犯罪；还有的犯罪虽然通常情况下由作为形式实施，但也可以由不作为形式实施，这种情况下构成的犯罪被称为不纯正不作为犯罪，也称为不纯粹不作为犯罪。
