票据资金是指发票人与付款人间的基础关系。汇票与支票的付款人,在承兑或付款时,与发票人间有资金关系存在。本票因发票人即为付款人,除有担当付款的情形外,资金关系则不存在。资金除金钱外,实物、债权、信用等也可充当。但票据为文义证券,其权利义务只以票据记载的文义为准。资金关系存在与否,并不影响票据上的权利义务。故无资金而发行票据的,票据仍为有效。支票则为例外。如无资金而发空头支票,则应受法律制裁。
