社会契约是某一社会全体成员就该社会行动的基本准则取得的一致协议，通常带有假设或想象性质。在18、19世纪，此概念曾用来解释民族国家的存在，但其后就废弃不用了。直至约翰·罗尔斯在他的《正义论》中重新提出这一概念，并对其进行了修正。罗尔斯分配公正理论的基础就是某种形式的社会契约。与法律契约不同，社会契约在很大程度上取决于传统习俗约束力。
