用人单位的规章制度违反法律、法规的规定，损害劳动者权益的；
The bylaws thereof are inconsistent with any law or regulation and impair the rights and interests of the workers;
由用人单位提供的合同文本，应当遵循公平原则，不得损害劳动者的合法权益。
In case that the employer-unit provides the text, the principle of fairness shall be followed and shall not infringe upon the legitimate rights and interests of the employee.
给劳动者造成损害的，应当承担赔偿责任。
If harm is done to laborers, it shall assume compensation liability.
