想象竞合犯也称观念的竞合、想象的数罪，是指基于数个不同的具体罪过，实施一个犯罪行为，同时侵犯数个犯罪客体，触犯数个异种罪名的情况。例如行为人甲欲杀死某乙，开枪后不仅致乙死亡，而且又致乙身旁的丙轻伤，就属于想象竞合犯。我国刑法没有明文规定的想象竞合犯，但这一概念在刑法理论上一直是被承认的，并为司法实践所普遍接受。
