建设单位是指执行国家基本建设计划，组织、督促基本建设工作，支配、使用基本建设投资的基层单位。一般表现为：行政上有独立的组织形式，经济上实行独立核算，编有独立的总体设计和基本建设计划，是基本建设法律关系的主体。其权利和义务是：执行国家有关基本建设的方针、政策和各项规定；编制并组织实施基本建设计划和基本建设财务计划；组织基本建设材料、设备的采购、供应；履行进行基本建设工作的一切法律手续；负责与勘察设计单位签订勘察设计合同，负责与施工单位签订建筑安装合同；对竣工工程及时验收、办理工程结算和财务决算。
