The North East Chamber of Commerce (NECC) has questioned the project's need and scale.
Indeed, the NECC scandal has been cited as an example in which compounded Avastin may be worrisome.
Last month, NECC's owner and director, Barry Cadden, cited his constitutional right to remain silent before the subcommittee.
After all, since 2002, NECC has been subject to repeated regulatory run-ins.
The public health department in October permanently revoked NECC's license to operate as well as the licenses of its three principal pharmacists.
Investigators arriving at the company on September 26 "found NECC employees cleaning sterile compounding areas and and conducting environmental testing, " the report says.
The agency also tagged NECC for sending promotional materials to ophthalmologists, when the drug was not approved for wet AMD ( see here).
But some traders and the North East Chamber of Commerce (NECC) have said there is not enough demand for a development of this size.
The NECC has supported some of the scheme but said it was concerned plans for a large shopping development would badly affect the town centre.
As the NECC case illustrates, that can be a tragic miscalculation.
For example, in 2004, Reuters reported, the FDA and the Massachusetts Board of Pharmacy inspected NECC and in 2006 the FDA issued a warning letter.
On Monday, the board authorized DPH staff to seek the permanent surrender of the licenses of the NECC principals, who are prohibited from practicing pharmacy throughout any appeals.
While the NECC backed some of the scheme, including the food store, it said it was concerned plans for more large scale retail space would badly affect the town centre.
On October 15, federal authorities said that another NECC steroid injection, triamcinolone acetonide, might have caused a patient to acquire fungal meningitis, and they began contacting all 192 state facilities that received any NECC injectable products.
"NECC's transparency in dealing with the board since inception in 1998 demonstrates its good faith intention to operate in compliance with the requirements of its license, " said Paul Cirel, a Boston-based lawyer representing the compounder, in a statement on Tuesday.
The outbreak has been called one of the worst public health crises in the US in decades and the FDA has been under Congressional pressure to respond, especially after inspecting NECC in 2002 and issuing a warning letter in 2006, but failing to follow up with enforcement actions.
