In other words, if the Commerce Department can demonstrate that the item in question is either produced indigenously in the controlled country, or available from a third country which does not maintain stringent export controls, the law stipulates that U.S. manufacturers of such items should not be disadvantaged by having to operate under an unfair control regime.
