Levine had overturned an earlier preemption standard, and that its request for input from the solicitor general on another case involving Wyeth Pharmaceuticals drug Reglan in May suggested it was still looking at the issue of preemption in a broad light.
"Our New York State representatives could not and did not have the time to request and receive the input of their constituents regarding this matter, " said the repeal resolution adopted 13-1 by the Greene County Legislature this week.
