Whether there was a jurisdiction to make that order is very doubtful for the reasons given in my earlier judgment but in any event the order had been (or should have been) discharged by the time the Contested Notice was published.
Indeed, if banks were unregulated, and as such free to succeed and fail, investors and financial institution creditors would make sure that none grew too large given the losses they would suffer in a free market forany bank committing ghastly errors.
