It appears the analytic case for killing the vehicle rests upon the illogical reasoning that enemies have become more capable and therefore the Marines should wait longer to acquire a less agile, less protected means of getting ashore.
Don Barrett, an attorney with Barrett Law Office who represents the owners association, said the reasoning rejected by the court came from the district judge in the case.
Judge Saverio Chieffi told the court he would publish the reasoning behind his decision within 90 days, after which the parties would have 45 days to present their case.
