身份权，是指公民和法人依一定行为或基于相互之间关系所发生的一种人身权利。如亲权、荣誉权、婚姻自由权等。有些身份权是由当事人特定的行为所引起的，如某人因贡献突出获某项奖励，取得一项荣誉权。有些身份权发生在亲属之间，例如在婚姻存续期间，夫妻有相互扶养的义务，夫妻双方无论哪一方丧失劳动能力或生活困难，都有向对方要求给予经济上补助和生活上照顾的权利。
