谦抑原则，刑法学术语。又称必要性原则，是定罪的基本原则之一。所谓刑法的谦抑原则，是指用最少量的刑罚取得最大的刑罚效果。它是指立法机关只有在该规范确属必不可少――没有可以代替刑罚的其他适当方法存在的条件下，才能将某种违反法秩序的行为设定成犯罪行为。
