被拆迁人是指被拆除房屋及其附属物的所有人和被拆除房屋及其附属物的使用人。被拆迁人可以是对房屋享有所有权的人，即所有人；也可以是对房屋享有合法使用权的人，即使用人；还可以是对房屋享有共有权的人，即共有权人。
本条例所称被拆迁人是指被拆迁房屋的所有人。

房屋承租人，是指与被拆迁人具有合法租赁关系的单位和个人。
The lessee of the house refers to the unit or individual person who has established legal lease relationship with the"owner".
因而在拆迁过程中，必须给予被拆迁人合理补偿，对其进行妥善的安置。
