第三人清偿是指由第三人为消灭债务，以自己的名义向债权人为清偿。清偿一般是由债务人为给付行为，但也可以由第三人代债务人清偿债务。当第三人的给付能够使债权人得到满足，同时又对债务人并无不利的，原则上第三人的清偿应为有效。
