立案条件是司法机关决定受理案件的条件。符合立案条件的才可以立案，不符合立案条件的就不能立案。立案条件主要是：(1)案件依法应由本机关管辖；(2)经审查案件来源材料（控告、检举、自首等），确实存在犯罪事实；(3)根据犯罪事实的情节需要追究刑事责任。如案件不属自身管辖，应移送主管机关。如无犯罪事实，或犯罪事实显著轻微，不需要追究刑事责任的则不予立案。
