状态犯，是指犯罪完成以后，其行为所造成的不法状态处于继续状态的犯罪。即犯罪行为已经完成，达到了既遂，但是犯罪行为所造成的不法状态仍然继续存在。如盗窃罪，行为人窃得公私财物以后，其非法占有他人财物的状态可以继续存在一定时期，因而属于状态犯。状态犯与继续犯不同，状态犯是犯罪行为完成后所造成的不法状态的继续，而继续犯则是犯罪行为与不法状态同时继续。
