法律冲突，是指涉外民事关系中所涉及的外国法的规定与处理该关系的法院地法对同一问题规定歧异的情况。产生法律冲突的条件为：有关国家的法律对同一问题作了不同的规定；处理该关系的法院所属国家承认外国规定的效力。解决法律冲突的方法有：（1）在国内法或国际条约中规定冲突规范，指明某种关系应适用何国法；（2）国家之间以条约或公约的形式制定缔约国之间共同遵守的统一实体规范。
