夫妻间的法定财产制又称补充财产制，是指夫妻在婚前或婚后没有对其选择适用的夫妻财产制进行约定或其约定无效时，依照法律规定所直接适用的夫妻财产制。设置法定夫妻财产制的目的，是为了保障夫妻在婚姻家庭共同生活中的经济需要，解决在夫妻没有对其选择适用的夫妻财产制进行约定或约定无效等情况下的夫妻财产所有权的归属问题。法定财产制是法律预先设置而仅在无财产制约定或约定无效的情况下才能直接适用的一种夫妻财产制，是对约定财产制的必要补充。
