无名合同是“有名合同”的对称。法律上没有赋予其一定名称的合同。即有名合同以外的其他合同。由于人的经济活动的复杂性，难以在有关法律上对可能发生的所有合同都一一命名，故对于有名合同之外的合同，只要原则上不违背国家立法精神，不违反社会公共利益，也承认其具有法律效力。无名合同的订立、履行、变更以及解除和合同纠纷，可参照与该合同最为类似或基本类似的有名合同规定处理。如果没有类似的有名合同可以参考，可根据关于合同的一般规定和民法基本原则处理。
