拆迁人是指依法取得拆迁资格证书，自行或接受拆迁人委托对被拆迁人 进行拆迁动员，组织签订和实施补偿、安置协议，组织拆除房屋及其附属物的单位。
本条例所称被拆迁人是指被拆迁房屋的所有人。
