商住楼是指该楼的使用性质为商、住两用，商住楼一般底层（或数层）为商场、商店、商务，其余为住宅的综合性大楼。商住楼不分建设主体，不仅开发商可以建，非开发企业、个人也可以建，没有规定必须出售。商住楼的土地使用性质为综合用地，根据国家土地法规定，综合土地的使用权年限为50年。
