协议管辖又称合意管辖或者约定管辖，是指双方当事人在合同纠纷或者财产权益纠纷发生之前或发生之后，以协议的方式选择解决他们之间纠纷的管辖法院。债权纠纷中，只有合同之债可以协议管辖，2012年民事诉讼法修改，关于协议管辖的适用范围，在原有的“合同”纠纷的基础上，增加了“其他财产权益纠纷”。其他财产权益纠纷包括因物权、知识产权中的财产权而产生的民事纠纷。
