动产是指能脱离原有位置而存在的资产，如各种流动资产、各项长期投资和除不动产以外的各项固定资产。 中国的动产善意取得的制度设计，亦应遵循债权形式主义物权变动模式的一般规则，即以有效的债权合同为基础，并结合交付和登记始发生物权变动。因此，动产善意取得不是基于无效合同，第三人强行“原始取得”所有权。第三人的善意也不能补正无权处分行为的效力，而是使得原所有权人的追及权受到限制。善意取得是根据无权处分人和受让人对财产的“双重占有公信力”而发生的。
