制定法又称成文法，指国家机关依照一定的程序制定和颁布的，表现为条文形式的规范性法律文件。习惯指经有权的国家机关以一定方式认可，赋予其规范效力的习惯或者惯例。现行我国大部分法律为制定法。习惯法并不是指某一整部法律均为习惯法，而是在制定法中对某些惯例予以承认 比如农村土地承包经营制，还有一些少数民族的古老制度。事实上也表现为了制定法的形式。习惯法这个概念在我国意义不是很大，主要是在英美法系应用的多。非要在我国找出完整意义上的习惯法只有国际法中的国际惯例。
