刑事诉讼参与人，是指在刑事诉讼活动中除侦查、检察、审判机关工作人员以外参加刑事诉讼活动，依法享有一定的诉讼权利，承担一定的诉讼义务的人员。根据刑事诉讼法的规定，刑事诉讼参与人主要包括：当事人、法定代理人、诉讼代理人、辩护人、证人、鉴定人和翻译人员。依据诉讼参与人同案件的利害关系不同，可以将诉讼参与人分为当事人和其他诉讼参与人两类。
