刑法中的保护原则以保护本国利益为标准，凡侵害本国国家或者公民利益的，不论犯罪人是本国人还是外国人，也不论犯罪地在本国领域内还是在本国领域外，都适用本国刑法。 刑法第8条规定：“外国人在中华人民共和国领域外对中华人民共和国国家或者公民犯罪，而按本法规定的最低刑为三年以上有期徒刑的，可以适用本法，但是按照犯罪地的法律不受处罚的除外。”根据这一规定，外国人在我国领域外对我国国家或者公民犯罪，我国刑法有权管辖，但是，这种管辖权是有一定限制的：一是这种犯罪按照我国刑法规定的最低刑必须是3年以上有期徒刑；二是按照犯罪地的法律也应受刑罚处罚。当然，要实际行使这方面的管辖权存在着一定的困难，因为犯罪人是外国人，犯罪地点又是在国外，如果该犯罪人不能依法引渡，或者没有在我国领域内被抓获，我国就无法对其进行刑事追究。但是，如果刑法对此不加以规定，就等于放弃自己的管辖权。因此，作出这样的规定，是为了在法律上表明我国的立场，这对于保护我国国家利益，保护我国驻外工作人员、考察访问人员、留学生、侨民的利益是完全必要的。
