侵权行为之债，是指行为人不法侵害他人财产权利或人身权利而产生的当事人之间的权利义务关系。构成要件：（1）损害事实的存在。主要指财产上的损失，也包括因人身伤害所造成的财产上的损失，以及间接损失。（2）加害行为的违法性。正当执行职务的行为，不属侵权行为。（3）违法行为与损害事实间要有因果关系。（4）违法行为人主观上要有过错。
侵权行为之债有其独特性，发挥着缓解、调整和保护复杂社会关系的价值功用。
