依法仲裁是指仲裁员依据一定的法律对纠纷进行仲裁。这种方式下，仲裁有明确的法律依据，仲裁结果有可预见性，也易为当事人所接受。因此，依法仲裁是普遍适用的最一般仲裁方式。 以当事人选择或仲裁庭依据法律冲突规则所确定的某一国家的国内法作为裁决依据，往往会产生法律冲突问题；法律规则与灵活的实践相比具有滞后性。
自劳动争议调解组织收到调解申请之日起十五日内未达成调解协议的，当事人可以依法申请仲裁。
