价值判断(value judgement)即关于价值的判断，是指某一特定的主体对特定的客体有无价值、有什么价值、有多大价值的判断。更直白地说，就是人们对各种社会现象、问题，往往会作出好与坏或应该与否的判断。由于这种判断与人们的价值观直接发生关系，所以被称之为价值判断。我国司法学界普遍认为法律行为的成立是一个事实判断问题。
