仲裁是一个法律术语，是指由双方当事人协议将争议提交（具有公认地位的）第三者，由该第三者对争议的是非曲直进行评判并作出裁决的一种解决争议的方法。仲裁异于诉讼和审判，仲裁需要双方自愿，也异于强制调解，是一种特殊调解，是自愿型公断，区别于诉讼等强制型公断。 仲裁一般是当事人根据他们之间订立的仲裁协议，自愿将其争议提交由非司法机构的仲裁员组成的仲裁庭进行裁判，并受该裁判约束的一种制度。仲裁活动和法院的审判活动一样，关乎当事人的实体权益，是解决民事争议的方式之一。仲裁是舶来品，源于日本词汇，仲裁通俗理解就是让大家来评评理。
