人身危险性是犯罪人再次犯罪的可能性。刑法学新派曾使用这一概念，认为人身危险性是通过一系列外在征表体现出来的行为人可能实行犯罪行为损害社会的危险状态，是刑事责任的根据。刑法学新派，从防卫社会的目的主义出发，提出人身危险性概念，是对刑法学的一大理论贡献。但是刑法学新派脱离客观存在的犯罪行为，探讨人身危险性，对被认为有人身危险性但没有实行犯罪行为的人处以刑罚或保安处分，具有导致刑事审判主观檀断的危险。
