国家知识产权局专利复审委员会成立于1984年11月，当时全称为中国专利局专利复审委员会，为中国专利局内设机构。此后，伴随着1998年国务院机构改革以及2001年《中华人民共和国专利法》的修改，专利复审委员会经历了两次更名：1998年更名为国家知识产权局专利局专利复审委员会；2001年更名为国家知识产权局专利复审委员会。2003年底，经批准，专利复审委员会成为具有独立法人资格的国家知识产权局直属事业单位。
专利复审委员会复审后，作出决定，并通知专利申请人、专利权人或者撤销专利权的请求人。
