Splitting from a majority that included swing Justice Anthony Kennedy (and, curiously, Clarence Thomas) Roberts attacked his fellow justices for refusing to apply the Equal Protection Act to homeowners who paid 10 to 30 times as much in taxes as their neighbors.
But a future challenge in the Supreme Court could face a different outcome, as the three justices who dissented strongly from the majority Antonin Scalia, Clarence Thomas and John Roberts, the new chief justice will probably be joined soon by a like-minded fellow-Catholic, Samuel Alito.
