Defence lawyer Joe Amendola said after the hearing that he had doubts that Sandusky had received dueprocess, saying that the defence team "ran out of time" to prepare as the cases were rushed to trial.
The legal team filed a lawsuit accusing the INS of violating Elian's dueprocess rights and asked the judge to prevent the agency from returning the boy before it gives him an asylum hearing.
