专利实施许可也称专利许可证贸易，是指专利技术所有人或其授权人许可他人在一定期限、一定地区、以一定方式实施其所拥有的专利，并向他人收取使用费用，分为制造许可、使用许可、销售许可等，具有专利技术成果的转化、应用和推广的作用。
专利权有效期限届满或者专利权被宣布无效的，专利权人不得就该专利与他人订立专利实施许可合同。
