知识产权是指人类智力劳动产生的智力劳动成果所有权。它是依照各国法律赋予符合条件的著作者、发明者或成果拥有者在一定期限内享有的独占权利，一般认为它包括版权（著作权）和工业产权。版权（著作权）是指创作文学、艺术和科学作品的作者及其他著作权人依法对其作品所享有的人身权利和财产权利的总称；工业产权则是指包括发明专利、实用新型专利、外观设计专利、商标、服务标记、厂商名称、货源名称或原产地名称等在内的权利人享有的独占性权利。 自2008年《国家知识产权战略纲要的通知》颁布之后，我国陆续出台了《商标法》、《专利法》、《技术合同法》、《著作权法》和《反不正当竞争法》等法律法规文件。从宏观层面上讲，国家已经在法律制度层面为企业知识产权权益的保护提供了较强的法律依据，为企业在制定知识产权保护制度及具体实施方法指明了方向，但是目前还缺乏侵权案件的单独法律法规详细文件。为保护企业商业机密，建议制定《企业商业机密保护法》、《知识产权法》等文件，详细制定企业与企业之间，企业与员工之间的商业机密文件的保护和侵权条例。 2018年11月9日，在首届中国国际进口博览会开幕式上，中国宣布，坚决依法惩处侵犯外商合法权益特别是侵犯知识产权行为，提高知识产权审查质量和审查效率，引入惩罚性赔偿制度，显著提高违法成本。
