合同债权（Contract Creditor's Rights）合同债权，是指基于合同关系，一方当事人（债权人）可以向对方当事人 （债务人）请求给付的权利。合同债务与物权不同，合同债权是基于当事人双方之间订立有效合同关系而存在。合同债权是相对权，存在于特定的当事人之间，债权人对于给付标的物或者债务人的给付行为并无支配力。更重要的是，合同债权不具有典型的社会公开性，其他人难以知悉。这是合同相对性原则的突出体现。
