国际投资法是关于外国投资保护的国内法规范和国际法规范的总称。国内法规范，即资本输出国为保护本国国民海外投资的海外投资保险法，和资本输入国为保护、鼓励与限制引进外资和技术的外国投资法，以及有关的外汇管理法、涉外税法等。国际法规范，即调整两国间或多国间私人投资关系的保护外国投资的国际法制度，如双边投资保证协定、处理投资争议国际公约以及国际惯例等。国际投资法是调整投资环境的有效手段。
