中医药是我国的瑰宝。对传统知识提供有效的知识产权保护，不仅符合我国的利益，而且有利于在世界范围内弘扬中华文化。而我们在国际竞争中面临一些不利状况：一是我国作为中医药原创国的主体地位受到了一些外国的威胁。中医药作为我国具有原创性的自主知识产权，目前在国际上正面临被混淆来源的危险。
