On the other hand, Zerbe said, another tax change Congress is considering could hurt auto dealers--and needs to be rethought.
Zerbe suggested two other changes that would get money into taxpayers' hands now, but be partially offset by higher revenues later.
Experts say Mr. Birkenfeld's involvement in UBS's activities will likely lower his award for turning in the big bank, but Mr. Zerbe says he believes he will receive one.
"Bringing in more complication to the tax code, another difficult tax provision for the IRS to administer, and dubious tax policy at best is not the answer, " Zerbe said.
At a recent conference, Zerbe noted approvingly, his former boss Grassley, the ranking Republican on the Senate Finance Committee, suggested changes to the AMT, which would allow these old unused credits to be claimed retroactively.
But both Stretch and Zerbe have an answer to that: Include tax breaks that would put cold cash now in many businesses' hands--for example, an extension of the now-two-year-period in which business can carry back their net operating losses.
