On Sept. 15 The NewYork Festivals announced a new judging system, whereby Grand Jury judges are now allowed to flag a suspected scam ad by checking a box when viewing an entry online.
Stephen Kaliski and Matt Gorman, sophomore roommates at NewYork University showed up at Times Square with an American flag normally hung on their dorm-room wall.
But the apps challenge a central tenet of the NewYork taxi market: Yellow cabs can accept customers who flag them down on the street, but cannot "prearrange" a fare by phone or radio.
However, the federal court of appeals based in NewYork rejected that contention and found YouTube might be liable under either a red flag knowledge theory or based on its willful blindness.
