The 2nd Circuit Court of Appeals ealier this week refused to reconsider its earlier decision to dismissalawsuit accusing Bayer AG of paying rivals to stay out of the generic Cipro market.
He said he was inclined to dismiss the lawsuit by a group of villagers who claim to represent thousands of indigenous people in an area where Texaco drilled for oil from the 1960s until it was ejected from the country in 1992.
