In June 2000 Arafat tasked Fatah commander Marwan Barghouti with forging operational alliances with Hamas and Islamic Jihad and forming the Aksa Martyrs Brigades terror group from Fatah forces.
Acting on Arafat's orders, Barghouti formed the Aksa Brigades terror cells comprised of Fatah members and the Popular Resistance Committee terror network that combined Fatah, Hamas and Islamic Jihad terror cells.
The indictment was filed against him in 2007 following a speech he gave at a demonstration in Jerusalem in which he accused Israel of seeking to destroy the Aksa Mosque on the Temple Mount.
He did not precondition talks on freezing illegal Arab construction in Jerusalem, or on dismantling the Aksa Martyrs Brigades terrorist group, or even simply on setting aside the Palestinian demand that Israel release convicted terrorists from its prisons.
